Article 1. Scope of Application

Wakam places the utmost importance on the protection of data collected as part of its activities, as well as compliance with applicable laws and regulations in this regard.

This Privacy Policy (hereinafter referred to as the “Policy”) aims to provide simple, clear and comprehensive information regarding the processing of your personal data by Wakam, acting as the data controller.

The Policy covers the following operations:

  • Browsing on Wakam’s websites;
  • Online requests.

Article 2. The Data Controller

When you browse the website www.wakam.com, personal data is processed electronically by Wakam, a public limited company with a share capital of €4,720,928, registered with the Paris Trade and Companies Register under number 562 117 085, whose registered office is located at 120-122 rue Réaumur – 75002 Paris, France.

For all such processing, Wakam determines the means and purposes of the data use and therefore acts as the data controller within the meaning of the applicable regulations, in particular Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR).

Article 3. Purpose of Processing Personal Data

Wakam collects various types of personal data for the following purposes:

Website management:

  • Monitoring contact requests and complaints;
  • Website navigation;
  • Management of the Play & Plug platform.

Article 4. Data Collected by Wakam

Wakam collects different types of data when you browse the site, including:

Browsing and website usage data such as:

  • Your IP address and other device identifiers;
  • Operating systems and browser types;
  • Information about the pages you visit, collected through cookies or other tracking technologies.

Connection data:
(IP addresses, connection logs);

Private data related to commercial and/or contractual relationship follow-up
(e.g. a file or case number).

Article 5. Data Retention Period

Wakam retains your personal data only for as long as necessary to fulfil the purpose for which the data is held, in order to meet your needs or comply with our legal obligations.

If you are a policyholder, meaning you have entered into an insurance contract with Wakam, the following criteria apply:

  • Data collected during website browsing will be deleted within a maximum of 13 months.
  • Data collected via the Play & Plug platform will be retained until the end of the contractual relationship with the partner, and for 5 years thereafter.
  • Data collected via the contact form will be retained by the relevant department for the time necessary to respond to your request, and then deleted.
  • Data collected via the API portal will be kept for the entire duration of the contractual relationship:
    • For Wakam partner users, data will be kept for 5 years after the end of the business relationship.
    • For non-partner users, data will be retained until you request its deletion or after 3 years of inactivity.

Wakam may retain certain personal data to comply with its legal and/or regulatory obligations, exercise its rights (such as filing a claim in court), or for statistical or historical purposes. In such cases, all necessary measures are taken to ensure data security.

When Wakam no longer needs to use your personal data, it will delete it from its systems and files or anonymise it so that you can no longer be identified.

Article 6: Personal Data Security System

Wakam is committed to protecting the personal data it collects and/or processes against any loss, destruction, alteration, unauthorised access or disclosure. To this end, Wakam implements appropriate technical and organisational measures, based on the nature of the data and the risks involved in its processing, to preserve the security and confidentiality of your personal data. These measures may include practices such as limited data access for authorised personnel based on their roles, contractual safeguards when using external service providers, privacy impact assessments, regular reviews of our privacy policies and practices, and physical and/or logical security measures (secure access, authentication procedures, backups, antivirus software, firewalls, etc.).

Article 7: Recipients of Personal Data

Your personal data may be shared with the following recipients:

Persons acting as part of their regular duties, including but not limited to:

  • Staff responsible for issuing, managing, and executing insurance contracts, including claims handling;
  • Delegated management entities, insurance intermediaries, insurance bodies managing contracts on Wakam’s behalf within a partnership framework;
  • Subcontractors, and entities within the same group as Wakam, in the performance of their duties.

Authorised third parties, including but not limited to:

  • Relevant courts, arbitrators, mediators;
  • Supervisory and regulatory authorities and all authorised public bodies;
  • Auditing bodies such as statutory auditors and internal control services.

Wakam never shares your personal data with other companies for marketing or commercial prospecting purposes.

Article 8: Exercising Your Rights

  • Right to information: You have the right to obtain clear, transparent and easily understandable information about how your data is used and your rights.
  • Right of access, rectification and deletion: You have the right to:
    • Access the personal data held by Wakam and obtain a copy;
    • Have any inaccurate data concerning you corrected;
    • Request the deletion of your personal data under certain conditions.
  • Right to data portability: You can request that your personal data be provided in a structured format for use in another database.
  • Right to restrict processing: Under certain circumstances, you may request that the processing of your personal data be temporarily suspended.
  • Right to object to processing based on legitimate interests.
  • Right to withdraw consent at any time.
